MINUTES
The Uvalde County Commissioners Court met in regular session at 10:00 a.m. on December 10, 2007 in the Commissioners Courtroom of the Uvalde County Courthouse, with the following members present:
William R. Mitchell, County Judge
Randy Scheide, Commissioner #1

Jerry W. Bates, Commissioner #3

Lucille C. Hutcherson, County Clerk and Ex-Officio Clerk
of the Commissioners Court of Uvalde County
Also present were County Treasurer Joni Deorsam, County Tax Assessor-Collector Maggie Del Toro, County Auditor Alice Chapman, and Road Administrator Jesse Garcia.
1. CONSIDER AND ACT UPON CALL TO ORDER, ROLL CALL AND PLEDGE OF ALLEGIANCE:
The Honorable William R. Mitchell called the meeting of December 10, 2007 to order; gave the invocation; led the pledge of allegiance to the United States of America and Texas flags.
2. CONSIDER AND ACT UPON APPROVAL OF MINUTES:

3. CONSIDER AND ACT UPON PUBLIC HEARING REGARDING ADOPTION OF COUNTY ROAD MAP:
The Commissioners Court may propose a county road map that includes each road in which the County claims the existence of a public interest. The County has given notification to landowners by placing a notice concerning said proposed map in their tax statements, as require by law. If the Court chooses to formally adopt the proposed map, it must be done at a public meeting held before the 90th day following the date of this public hearing. (Chapter 258 Transportation Code)

County Attorney John P. Dodson informed the audience that at this public hearing anyone asserting a private right, title, or interest in a road in which the County has claimed the existence of a public interest may appear before the Commissioners Court to protest the County’s claim.

15. T.W. and Mary Smith – submitted written objection to CR #364

The Court took no action under this agenda item.
4. CONSIDER AND ACT UPON PUBLIC HEARING REGARDING TAXATION OF GOODS IN TRANSIT:
Judge Mitchell stated that HB 621 allows for Counties to tax Goods In Transit and that the Court must hold a public hearing prior to the adoption of the act.
There were no public comments during the public hearing regarding this agenda item.
5. CONSIDER AND ACT UPON RESOLUTION ADOPTING TAX ON ITEMS IN TRANSIT:

· Second by Commissioner Sanchez
The Court approved (3-1) the adoption of An Order Of Uvalde County To Tax Tangible Personal Property In Transit Which Would Otherwise Be Exempt Pursuant To Texas Tax Code, Section 11.253. A copy of said Order is attached to these minutes.

6. CONSIDER AND ACT UPON PRESENTATION OF EMERGENCY SERVICE DISTRICT AUDIT:

The Court unanimously (4-0) approved the Bandera, Uvalde, Medina and Real County Emergency Services District annual audit. A copy of said audit is attached to these minutes.

7. CONSIDER AND ACT UPON RESOLUTION TO DESIGNATE DEPOSITORY AND SIGNATORIES FOR TCDP GRANT:

The Court unanimously (4-0) adopted a Resolution designating the County Judge, County Treasurer and County Auditor as the signatories and the First State Bank of Uvalde as the depository for the Texas Community Development Program Contract No. 727480 Texas Community Development Grant for Improvements to the Community Health Development Inc., Capital Improvement Program. A copy of said resolution is attached to these minutes.
