MINUTES

 

 

 

The Uvalde County Commissioners Court met in regular session on March 27, 2006 at 10:00 a.m. in the Commissioners Courtroom of the Uvalde County Courthouse with the following members present:

 

                                                William R. Mitchell, County Judge

                                                Randy Scheide, Commissioner #1

                                                Mariano Pargas, Jr., Commissioner #2

                                                Jerry W. Bates, Commissioner #3

                                                Jesse R. Moreno, Commissioner #4

                                                John P. Dodson, County Attorney

                                                Lucille C. Hutcherson, County Clerk and Ex Officio Clerk

                                                            Of the Commissioners Court of Uvalde County

 

Also present were County Tax Assessor-Collector Maggie Del Toro, County Auditor Alice Chapman, County Sheriff Terry Crawford, and Road Administrator Wayne Everett.

 

The Court opened with the Honorable William R. Mitchell giving the invocation; the following proceedings were had:

 

1.                  CONSIDER AND ACT UPON APPROVAL OF MINUTES:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Bates

The Minutes of March 27, 2006 were unanimously approved as written.

 

  1.       CONSIDER AND ACT UPON SWEARING-IN OF CONSTABLE,

PCT. 2:

Judge Mitchell reminded the Court that Constable Precinct 2 Jesus Reyes resigned his position to run for Justice of the Peace, Pct. 2.  The Court accepted his resignation but allowed him to continue to hold the office until his successor was selected.  Weldon McCutchen ran for the Constable position in the March 2006 primary and was selected as the Democratic Party nominee.  With no Republican candidate, Mr. McCutchen is ready to be sworn in as Constable, Precinct 2. 

 

Weldon McCutchen was sworn into office as Constable Pct. #2 by Judge Mitchell.

 

No action was taken under this agenda item.

 

 

 

  1.      CONSIDER AND ACT UPON EXTENSION OF CURRENT BAN ON        

OUTDOOR BURNING:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Moreno

The Court unanimously approved to table this agenda item until a subsequent meeting.

 

  1.       CONSIDER AND ACT UPON APPROVAL OF PRELIMINARY PLAT  

OF PARADISE OAKS SUBDIVISION, PHASE 2:

This agenda item was withdrawn, per request.

 

  1.       CONSIDER AND ACT UPON ISSUING CERTIFICATES OF  

OBLIGATION FOR FUNDING COUNTY JAIL CURRENT

OPERATING EXPENSES IN EXCESS OF BUDGETED AMOUNT:     The Court and County Auditor discussed inmate housing and inmate medical expenses which have exceeded the amount budgeted in the 2005-2006 fiscal year.  During discussion Ms. Chapman requested that the Court give authorization to the County Judge and County Treasurer for issuance of anticipated tax and revenue notes. 

 

The Court passed this matter and will address it further at a special workshop at a date to be determined.

 

  1.       CONSIDER AND ACT UPON REQUEST OF SABINAL EMS FOR

ADDITIONAL FUNDING:

Judge Mitchell informed the Court that the Sabinal EMS is requesting $5000.00 in additional funds beyond the budgeted amount of $30000.00.

·        Upon motion of Commissioner Bates

Commissioner Bates made a motion to extend the Sabinal EMS the amount of $5000.00. The motion died from lack of a second.

 

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court approved 3-1, with Commissioner Moreno voting “No”, to give the Sabinal EMS an additional $2500.00.  The said amount will be paid out of the Tobacco Fund.

 

7.        CONSIDER AND ACT UPON PRESENTATION OF 2005 AUDIT    REPORT BY BEYER AND COMPANY:

Wayne R. Beyer, C.P.A., stated that Beyer and Company had conducted an audit in accordance with auditing standards generally accepted in the United States of America.  Those standards require that the audit is planned and performed to obtain reasonable assurance about whether the general purpose financial statements are free of material misstatement.  An audit includes examining, on a test basis, evidence supporting the amounts and disclosures in the general purpose financial statements.  An audit also includes assessing the accounting principles used and significant estimates made by management, as well as evaluating the overall general purpose financial statement presentation. As a result of the independent audit Beyer and Co gave the County an unqualified opinion, which is the highest form of an opinion.

 

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Moreno

The Court unanimously accepted and approved the audit report by Beyer and Company.  A copy of said report is attached to these minutes.

 

       8.       CONSIDER AND ACT UPON ORDER SETTING RATE PAID TO       INDIVIDUALS SERVING ON A JURY:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved an ORDER SETTING JUROR PAY FOR THE COUNTY OF UVALDE PER S.B.1704.  A copy of said order is attached to these minutes.

 

       9.        CONSIDER AND ACT UPON ROAD ADMINISTRATORS REPORT:

Road Administrator Wayne Everett gave the following activity report, with no action being taken:

      - Construction on 7 Bluff Crossing halfway complete

      -Routine Maintenance

      -Clean up in Uvalde Estates

 

      10.       CONSIDER AND ACT UPON LINE ITEM BUDGET AMENDMENTS:

·        Upon motion of Commissioner Scheide

·        Second by Commissioner Bates

The Court unanimously approved the line item budget amendments, as presented.

 

11.              CONSIDER AND ACT UPON PAYMENT OF BILLS:

·        Upon motion of Commissioner Bates

·        Second by Commissioner Scheide

The Court unanimously approved the bills for payment.

 

12.              CONSIDER AND ACT UPON PAYROLL APPROVAL:

·        Upon motion of Commissioner Moreno

·        Second by Commissioner Pargas

The Court unanimously approve the payroll, as presented.

 

13.              CONSIDER AND ACT UPON MONTHLY REPORTS:

·        Upon motion of Commissioner Pargas

·        Second by Commissioner Bates
